My spouse has agreed to give me the house but I am not in a position to refinance to place the deed in my name only. Would the marital settlement contract be legally binding to allow me to release my spouse of all debt including the mortgage and also prevent my spouse from forcing me to sell the house at a later date?

Generally a divorce settlement is not binding on the lender. Do you have any equity in the house?
