Hi I've been dealing with a crazy situation it started with my neighbor upstairs from me writing letters of complaint against me to the rental board trying to get me evicted from my apartment that I've been living for over 38 years .now its been since October 10 of 2010 that I'm waiting for this date so what does she do !on April 3 2012 she called the police saying that I threatened and harassed her and got me arrested and released on conditions about not being 400 meters from her I find this completely unjustified when there's an 8 year old involved thanks for reading and can someone please help me I would appriciate it a lot

Police in general don't arrest someone just because someone else tells them to.
What actually happened on April 3, and why are you just now getting around to asking about it? There's no expiration date on the restraining order?
What does it mean that you are waiting now almost 2 years for some 'date' about the housing board?
And what does someone's 8 year old have to do with it?

Now as to regards of my son he almost failed his schooling over this
OK April the 3rd I'm laying down with my son watching netflix the police come to my door took me away for death threats and harassment when I didn't do anything we've been to court 2 times already the crown prosecuter doesn't want to lift the contitions so now iv'e been paying my rent since April and not allowed to go home I have many witnesses that are coming on auguest 31 after 23 months of not getting what she wants the neighbor fabricated this whole story about threatining her and her family they even did the same to my girlfriend who works for a heart tranplant surgent I find it hard to believe that people with such great jobs and tenants like myself that's been resiting in the same dwelling would be able to live that long in the same apartment when I go around threatening people

A judge, magistrate, or other judicial official set these conditions of release? If so, the jurist must have believed that there was something to it. In that case, no, you probably cannot successfully sue for harassment.

Yes and that something to it is a criminal record that I may quote was never violent

Sorry but if the court has upheld this, then they accepted it as true, so you can not sue.

Why not just move, if you can't go home, rent someone else and be done with it.

I telling you chuck you just don't understand how this problem started they have called the police 25 times 2010 for reasons like loud music bbq inviting all kinds of friends when in fact its all the other tenants that are out in the back the police come and leave cause its perfectly legal to drink on private property left over food in the hallway me and my visiters broke the mail box out in the back smoking pot with kids should I gone on!!

Yes, go to court on principle, but your story is still sort of hard to sort out.
And I don't think anyone here is willing to believe that both the police and the courts would arrest you AND keep you away from your home based on nothing but one person's report. There just had to have been a confrontation in front of witnesses - right? Or are you saying that several people lied for her?
The fact that you have been there 38 years doesn't mean anything, and now that your son is 8, he may be doing things you aren't aware of.

No, you don't need to go on. These things are quite enough to make it clear that your neighbor had ample reason to complain.

Dude I'm telling you this is how complex this story is the neighbor went around 2 years ago to sign a patition against me they ended up with 1 signuature the same person who signed the patition is on my side now because they see the problems I'm in she said that when the husband came around he said that he was going to clean out the blacks now the neighbors upstairs are russian and this witness their old friend is russian and she's coming to court to tell her story

Indeed it gets complex when you keep adding more and more meaningless details.

Great, now it's smoke and mirrors about race and nationality. I take it you are black and they are Russian.
I'm finding it harder and harder to believe that you didn't have a big public confrontation, because you keep talking all around the facts. Just because the police showed up afterwards and you were quietly watching TV doesn't mean much.
You'll have your day in court so what do you need us for?
You've got your witnesses, they've got theirs. Housing court cases are often won by the person who sounds the most calm, respectful of the court, and articulate. Judges get fed up pretty fast.
