We have an answer hearing coming up in a few days, were trying to obtain custody of our 10 yr old nephew. We've been working with cps, homestudy, background check etc. our nephew hasn't been ajudicated yet. The caseworker suggested having his mother stipulate at court, saying she wishes to sign custody to us and if and when she is able to care for her son she will petition the courts for custody. The mother said this is exactly what she wants to do. So Im wondering what are the odds of the Judge allowing this verses ordering him to state custody where we could just foster him and deal with cps for no telling how long?

As long as the mother shows up and doesn't change her mind, the odds sound pretty good... I know it's going to be a long few days waiting, but it sounds like you've done a lot of good groundwork for this.

Thanks for your response. I know she will show and pretty sure she want change her mind. Unfortunately the child has special needs and receives a ssi check to help support his needs, his mother doesn't want him but she wants to get her hands on his check. I am beyond stressed. Its not about money by far for us. The mother will try to manipulate us once we have custody of him. I still don't know how we will handle this situation, but first things first which is getting this child into a loving forever home.
