    Is this a hipaa violation and grounds to sue
    I had to et surgery and specifically had to get a doc note for some restrictions so I had to give my manager the results in what was going on I asked her over and over to keep it confidential and when I came back to work the info was leaked out to an employee? What can I do?

    You can to to your HR department. HIPAA is basically doctor/patient privilege. Since your boss isn't your doctor there was no violation.

    Leaked what to who? Not a HIPAA violation and I see no grounds for a suit, you have no damages.

    Even if it were a HIPAA violation (which, as said, it isn't), it wouldn't be "grounds to sue". The HIPAA regulations don't (with very limited exceptions) authorize a lawsuit for money damages.

    It seems to be one of those strange myths, which is encountered here often, that a violation of HIPAA means money to the patient. It doesn't.

    If this was a HIPAA violation ( and it is not) you could report it, and hope that they may keep something in a their file. It is not a way to get any money.

    But, it most likely breaks some company rule, so you can go to HR and report the issue. But in the work place, it is hard to keep illness secret.
