    My husband died this year and I found out he has not filed taxes since 2003. He has refunds due and I wanted to know how far back can I file. I was told the statute of limitations restricts me to 3 years but since he never did file does this still pertain to me.

    The statue of limitations will allow you to claim refunds for 2009, 2010 and 2011,

    The refunds from all previous years have been forfeited.

    You will need to file for the last SEVEN years, or from 2005 to 2011.
