    Eviction and process
    I have to evict someone renting my sons property in New York upstate not the city.. I have power of attorney I know I have to give a 3 day notice of demand pay or quit etc... what I want to know if the time comes where I have to go to court after the 3 day... do I put my name on the documents or his name since he is in jail and I am his power of attorney.. I have them filled out either way so not to have a mistake get it done now so later I just have to wait the three days and then file.. do I sign and fill out the paper work in my name or do I fill it out with his name then sign my name as his agent with power of attorney

    Depends on what the forms say. If they ask for the landlord's name use your son's. If they ask for who is signing sign your name as POA.

    Thanks they( not they per say but the forms said landlord/owner) ask for his name so I will have to sign as his agent with a poa.. since he is in jail for a while.. I just don't want any mistakes I want this person out... so thank you it helped.. :) just hope after he receives 3 day that he knows its real and he must pay... thanks again...

    You can as the Court clerk to look over the forms and make sure they are filled in properly.
