I am 74 years of age my wife only 46 we have two young children , I lost of my business due to the recession , and we have no money , I cannot work because of health problem , my wife work and earn mealy $4000 a month , she do not want to help me saying that I fail as a husband and should look after myself , I stay from friend to friend and look after my young child age 10 and my wife look after the teenager she just rent a new flat under her sole name , and cannot stay at her place because I am not on the lease as she mention , I do not have medical insurance or retirement benefit or even child benefit ,
We been married for over 26 years and now my wife act the way she will like a divorce telling me that I am a failure husband and to old.
I did take care of my family for 26 years in a lavishing way unfortunately I lost everything ,and now she earn money she want me out and do not want to help me financially or having a roof.
What are my right over her earning or the rental flat , we still in good terms and not divorce or legally separated but she act that way by renting a apartment under her sole married name and not helping me financially

You can certainly file for divorce and spousal support. As well as child support for the child living with you. She can file for support for the child living with her.

OK , this is my question I am married for over 26 years I have 2 children , because I lost all my business this year , my wife told me thatr I faill as a husband , she find a job and now taken a flat under her name , she mention to me that I am not welcome and my feelings are that really she want a divorce , I am looking after the young child and she his looking after the teenager , I have no job or any money , I live with some friends with my son , she earn nearly $4000 a month and do not want to help me , when I had money she live very well with plenty money from my business . What is it you expect from us? To wave a magic wand and solve your problems?

Your wife is still married to you therefore her married name is your last name. So why can't she use her married name? If you aren't signed on the lease it is not your property.

Your only choice is to file for divorce. If you can't afford an attorney, try elder care agencies to help you.
