We added the non biological father to the birth certificate after the child was about 6 months old. We got married about 2 years later andnow going through a divorce. Is it possible to get him off the birth certificate even if the non biological father does not want off? I live in Alaska.

You committed a fraud by lying to government authorities about the father of your child. Now you want to recant that fraud by removing his name.

If I were you I would leave well enough alone and go after him for child support.

How much trouble can I get into for that? Will he get in trouble to because he knew he wasn't the father and wanted to be put on there? To me it's worth coming out about the truth. The child and I would better off without him in the picture. Do you just file some sort of motion with the courts to get him off the certificate?

Depends on the area. You both committed perjury which is a criminal offense. If the prosecutor feels like prosecuting, you could get jail time.

Again, I would not try to get him off the certificate, unless you are replacing him. A court is unlikely to grant such a motion.

Yes, unless you want to go after the real father for support and add him or prove his paternity I would leave it alone, since the court will want someone to replace him.

Also if it was known he was not the father, even the legal father may have a law suit for keeping him away from his child.
