It is very doubtful he will be able to go to Cuba.

What country is he a citizen of ? What country passport does he have.
If he is not a US citizen and in the US, what passport and what visa is he here on ? Is he in the US legally ?

Hes here on a work visa. But somehow the travel agent supposedly called cuba and he was able to go. But now because she did him the favor she's having a sexual relation with him I just found outthrew our children :(

He's here from Cuba. Green card.. But travel agent helped him get to cuba supposedly by calling cuba.. then find out he's having an affair with her as well because she helped fixed his trip I believe illegally since there is an active restarining order against him for domestic violence. Can this travel agency be held liable since they issued the paperwork knowing he couldn't leave

Who says he can't leave? A restraining order in the U.S. shouldn't affect his ability to leave the U.S. Whether Cuba will let him into that country (At one point you say he is there, in another you imply he hasn't left the U.S. so it's confusing.) is another issue.
