    Tax Returns for L1 and L2
    Hi,

    I came to US with my family on 22-Oct-2006
    I have L1 Visa. My wife and kid (1.5 years) have L2 visa.
    We will here for 1 year.

    I have SSN and my wife and kid don't have SSN.

    Can you please let me know the process in filing the tax returns?

    Whether my wife and kid needs to apply for SSN (or) can I apply for ITIN for both of them and file the tax returns.

    Please advise.

    Ram, currently you are non-residents for 2006. You may file a 1040NR.

    Alternatively you may wait until you meet the SPT in 2007 and then elect to file as residents for 2006. The catch with this is that it requires you to report your worldwide income and then claim a foreign tax credit. This may not be a problem, depending on which country you are from and whether you have foreign investments etc.

    It really depends on your situation as to what is best to do.
