Ask Me Help Desk - Do I have good case for a lawsuit?

I live in Dallas TX and I was contacted by a detective in May 2012 and told a woman was arrested with my actual drivers license card which was expired and not valid and said she had permission by me to use my id which was false and also had two prior tickets in my name as well using the id. I provided a signed affidavit stating that was not true and she did not have my permission and she was put in jail for a few months is now out on probation however the other two tickets she was given using my id are still in my name and have not been dismissed. My question is how does someone get stopped and given not one but two citations using an expired id when they do not look like anything like the picture one was even for drug paraphernalia so if the two officers would have done their job correctly in identifying this woman I wouldn't be seeking help and advice. So do I have a case to sue both officers for failing to id this individual and the city of dallas? I have all ready filed formal written complaints as well but I am the one suffering the consquences for something I did not do. I can not get another id until this is resolved and the citations are on my record as well preventing me from getting jobs.

She was driving with your expired license. Now you can't get ID? What did you use to drive after your license expired? Didn't you get a replacement license immediately.

In my area if you sue a Government agency you have to give notice of your intent to sue within 90 days. Are you within 90 days?

Now if the driving citations are keeping you from getting employment and you can prove a monetary loss, yes, you have a case.

What did the Police Department say about properly ID'ing someone when you contacted them? I don't know what procedure Dallas follows. One ID? Two ID's?

Do you know that you and the woman look entirely different?

You can not sue the officers for this. How does it happen, driver license photos are lousy and esp with women they change hair color all the time, my wife is on her 4th color this year.

Women look almost totally different esp with makeup. Ever see some of those make over shows on tV

Have you also filed a stolen ID report, filed it with your credit reporting bureaus, have you checked your credit report to see if they used any accounts.

Of course the other issue was your license stolen, Is this a person that you know that was able to get the card?

I replaced my license when my wallet was stolen 7/2009 and gave all documents and reports to the dept of public safety at that time as of right now I have no vehicle and have not been driving because I don't have a valid license. My license expired on my dob this January 2012 tickets were received April 2012 & February 2012. I am within 90 days with my intent I need an attorney willing to take on the case. The police department agreed that she was not properly identified and waiting on a formal answer by the chief of police for my written complaint and I know she looks different from me because she has gold teeth that's how she was arrested and what the officer said in his report when she was arrested on top of the fact I looked up the jail record to see if I recognize her and I do not know this woman at all.

Gold teeth, they are covers that can be bought at fashion stores, I was a officer for years and merely gold teeth would not have even gotten attention if face same basic shape, race the same.

Some photos are lousy true but if the third officer who identified her and arrested her and said verbatim "this is not you" and was able to ditinguish her from me because the id was actually looked at then the photo not being good is not a good excuse. On top of the id being invalid and expired at the time of the citations. What's the purpose ofan id if the date and expiration or the photo do not matter?

These were not they were glued inside her mouth and I have a tattoo on the right side of my neck which is clearly in the photo and she does not... what's the next excuse? Clearly she was not me she was in jail and arrested with the id in her possession and charged so who dropped the ball? I followed every guidline and procedure for the id being stolen so why didn't the officers folllow protocol in id'ing her that's all I want to know.

Your license expired because you had a birthday. You should have renewed it then. I don't see that you were damaged by the theft of a since-expired license which theft occurred in 2009.

But I don't believe that you are telling us the full story about the authorities refusing to renew your license.

You don't have to believe me you're not a judge or representing my case I didn't renew my license at the time because I don't have a car and did not have the extra money too the facts are here. I have FBI fingerprinting clearance and a teaching cert for the state of Texas never been in trouble or giving a ticket in my life thank you. I am on here for advice not to plead a case.

I'm sorry, but there's a thin line between giving us the facts and pleading your case. No one can possibly know how to assist you without knowing all the facts.

You are arguing that you can't get ID and that you are greatly inconvenienced - you haven't (apparently) had ID for a while and managed to survive so that argument is not going to fly.

The only way to know if any Attorney will represent you is to start calling Attorneys and asking. Arguing with the very people who are trying to help you is (obviously) not going to help anyone.
