    The guy is a 100% in fault
    I got into in accident and the guy is totally 100% at fault. He was coming towards me on my side of the road on the highway and had supposedly taking 20 nerve pills.What save my life was that I gave it to the left so he hit me on the right end side of my car.He is only charged right now for impaired driving but he's in a psychiatric hospital.My back is killing me know but no damage was caused so. I just need to know if somebody's knows what I could get out of his insurance to cover my lost and the damage that he caused me not just physically but mentally.Cause the way I see it , he's going to get out of it with only paying me my car's worth and it's not enough for what could have happened if I wouldn't had the reflex that I did .

    First of all, I don't know when you had this accident, but if your back is "killing" you then you should seek medical attention. My dad was an insurance investigator and many times people fail to report their injuries because they don't think they are serious and end up having problems for years. The other guy's insurance will cover your medical expenses.

    As far as mental/emotional distress, it is very unusual to get a settlement for this unless there is something like Post Traumatic Stress Disorder caused by the accident. Even then, it's difficult (and usually more stressful) to prove. It would probably have to cause significant changes in your life (ie: unable to work, sleep disturbances, depression, anxiety, etc. for an extended period of time) in order for you to file a successful claim.

    I hope you are able to get through this quickly and suffer no long term problems. At least you are alive!

    I went to the hospital already and everything as been filed sooo for that I am fine (thank god) but see the prob is I don't know how the insurance world works
