back in 2003 my X BOYFRIEND and I adopted a little boy, we were never married.. the relationship ended but the adoptive father remained in my sons life calling and on occation visiting... my question is can I have him sign over his adoptive rights as he is now married , hasn't seen my son in over a yr and when he does its once a yr if that!

No... since he adopted him... he is for all legal purposes the father. It will remain as such unless there is another adoption.

Even if he was the bio father you couldn't get him to sign over rights. There is this myth that a parent can just sign over rights and its just a myth.

If YOU have remarried and your husband wants to adopt then yes he can agree to that.

I'm surprised you were able to adopt together, usually an adoptive couple needs to be married.

Yes we adopted together as my son was a foster child first... reading up online I see I can possibly motion for full custoday as his primary residence is with me... thank you everyone, I am waiting on call back from the lawyer who stood in for the adoption..

I will post back reply as to what he says I can do at this time...
