What To Do About Ohio Traffic Hearing Set During LA Court-Ordered Visitation?
My best friend's son is a juvenile residing in Ohio. He has court-ordered summer visitation with his family in Louisiana. Prior to his summer visitation he was in a very minor fender bender and his traffic court hearing was set right in the middle of his court-ordered visitation in Louisiana. My friend and his family do not have the money to fly or drive his son to Ohio for this hearing. There are also serious medical limitations involved, including my friend's upcoming open heart surgery. My friend's ex claims that the court date cannot be changed and is demanding that my friend risk his health to drive his son to Ohio for the hearing, even though she has the health and financial means to do this herself but won't. Are there legal grounds to request and obtain a postponement of the hearing given the court-ordered visitation in another state and my friend's inability to transport his son to Ohio for the hearing? Any and all help will be greatly appreciated.

Why not contact the Ohio Court and see if the hearing can be postponed. Don't trust what the ex is saying.

    Hello D:

It might not be EASY to change, but you can certainly change it.. Perhaps just a phone call to the clerk of court followed up with a certified letter.. But, postponements happen ALL the time, and you don't really need a legal reason.. You just need to have a conflict, and your son DOES.

Yes, also a traffic attorney is not very costly, often a few hundred dollars to get it posponed or even get it reduced.

What the ex is saying is obviously unreliable.
