    Hello,

    Can I legally move to another state ( without letting the other parent know) with my son and file for divorce first?

    My husband is very abusive, have reports of physical abuse and verbal on daily basis. We have a 5 and a half years old son. He isn't giving us money since September 2011. Have drinking habits( every night at least 6-10 beer cans gone)
    We r out of the country now, for vacation, and I am wondering can I move to another state( planning to move to Florida, living in L.A. Since 2006) after returning to US, but move to Florida and file for divorce there? I have friends to help us with my son to start new and happy life.

    You have to file for divorce in your State of residence. That would appear to be California.

    If there are daily reports why not get a restraining order first?

    As noted you have to file in your state of residence. So you would have to wait to establish residence in FL before you could apply there. That gives him the opportunity to file first.
