Can a person ask for charge to be dismissed to the judge
Can a person file a motion to dismiss or ask for a summary judgement before a person is picked up on an assault charge if they want to drop the charges and if so how do they go about doing it... Larue County... Kentucky... I want to have charges dismissed but the county attorney will not dismiss them... can I file paperwork to the Judge?

    Hello s:

If you're acting as your own attorney, sure you can. Of course, you have to have a reason...

Once a criminal complaint is made, it is up to the prosecutor to determine the disposition of the case. If the complainant no longer wants to pursue it, the accused can request a dismissal at arraignment.
