My 17 year old son does not want to live with his Mother any more. He is currently visiting me for the summer and does not want to go back home. I don't want to force him to live with his mom if he does not wish to. What are his and my legal rights here.

You do what the court ordered... and I assume they odered him to live with his mother...

Unless you want to be held in contempt of court. Or you could go back to court and try to get custody.

Agree with Smoothy - go back to Court and ask that the Order which is in effect be changed to you as the custodial parent.

His wishes will be heard but the Court is not under obligation to do what he wants.

I don't know how busy the Court calendar is - it's possible (depending on his date of birth) that he'll be 18 before this is heard.
