My husband moved out march 2012. Has decided to fight for full custody of our 2 children. He will call me vulgar names, threaten to take kids out of state,and make my life hell. When I react to this I have come to realize he starts recording on his phone. Of course at this time his demeanor will change.He has falsely acussed me repeatedly of being drunk. At one time accused me of hitting him in the face when I truly did not. He has a history of domestic violence.I recently found out he retained a lawyer in May 2009. I have been a stay at home mother for 11 yrs. When he left he took all money so I was not able to retain an attorney. 2 nights ago he came to the home, had me served with divorce papers. He then proceeded to pick a fight with me and the two neighbors that were at the house. He refused to leave, kept telling me to call the police. Unfortunately I did. My friends and I had drank 2 beers each. When police arrived he insisted the report reflect we had consumed alcohol.Have I given him the ammunition he needs to prove me unfit in NYS? I am so scared. I did get Temporary custody and a restraining order through family court so the harassment thankfully can not continue. Someone please help. I can not lose my kids.

Nowhere do I see anything about the children witnessing any of this. Did they?

He's had an Attorney for 3 years and just served you now?

I'd be careful, not do anything stupid but, again, I don't see any problems with your parenting skills.

Yes, they were with me at our home. I don't know how I could have been so blind. He has spent years setting me up. I have never been so scared.
