Ask Me Help Desk - Management Property

My property management company has been incompetent from not getting the second part of the lease signed to not fixing anything in the apartment accordingly. I have been w/o transportation since I moved in and my rent has been paid via money order from TX which takes like 3-4 days weather permitting... I have been having problems with them as far as the lease signing, rent payment, and maintenance. Recently my rent was late due to bad weather in TX they knew it was going to be late and posted a $105 late fee. I was told that they weren't going to process my $650 rent payment till the $105 was paid. My balance is now at $563. Is it possible for them to do such despite the fact that they haven't answered nor returned any of my calls but can surely call to add up ridiculous fees. Can they do that cause I really think they're tryna get over on me knowing I'm young and by myself in this town plus taking advantage of the fact that the payment MAY b late. Someone help me quick, I need answers.

You are responsible to send the rent payment early enough it won't arrive late... that makes it YOUR problem, not theirs... late is determined by when they receive it in their hands, not when you send it. If its due by the 1st... you have to get it out early enough they recive it NO LATER THAN the 1st, if they get it the 2nd then its late and subject to late charges. If those fees are in the lease... they aren't ridiculous.

You know they have those late fees.. yet you send it late then complain about them. The weather isn't their problem... your broken down truck isn't their problem... its YOUR problem to mail it out early enough to compensate for them.

And there is a very good legal reason for refusing to process a partial payment... it establishes a precedence which will reduce their legal rights in the case. (Such as considering repeated late and partial payments as a breach of lease to evict you)

You aren't going to like that answer, but those are the realities... if you don't meet your obligations on time... you are going to find yourself being evicted for breach of lease. And my best guess is that's what they are going for at this point.

If I had a tenant doing that its exactly what I would do.

You know they write money orders in the rain, on stormy days, even in the snow, the mail and post office is open in the worst of weather.

Also why does your rent come from there , is someone else paying your rent for you ?

Then they need to pay it a few days earlier, if it is arriving late or close to late, tell them to pay it a week early and it will be early not late.

Yes they may charge late fees if you are one day late. So you need to pay the rest of the late fees

That's what we have been doing its coming from TX cause my parents and I made an agreement that as long as I'm n school they'll take care of the rest and we've been sending the payment early and they startd doing this n Feb cause CO had a heavy snowstorm and they been had the check but didn't make sure then backdoor called me saying they been had it but still charged late fees... and havv been doing the same ever since they won't send maintenance, they neglected to get the other half of the lease signed and won't return my calls.

Well they aren't mailing it early enough... thats not your landlords problem... they likely are getting ready to evict you... and don't WANT it signed... seriously... of you have talked with them in the tone and attitude I've seen in this thread... I guarantee you they are preparing to evict you for breach of lease. Again... been a landlord... heard every excuse in the book... have a really poor image of renters as a result... sold the house to the first tenant that was honest and responsible after well over a decade of deadbeats and bums. As far as I know... almost 20 years later.. he still owns it and lives in it. Gave him the deal of a lifetime, and never regretted it.

And your next landlord if they are smart.. will be exactly the same way. Many tenants if you give them an inch they will take a yard... sorry, but that's true all too often. And that's from personal experience as landlords of a rental house.

They aren't required to send maintenance guys out within hours... sometimes they are only required to do it in days, longer on issues that don't affect suitability for habitation or safety... and the people that are habitually late and have a bad attitude go to the bottom of the priority list. No doubt you've earned a spot on their Sh*t list.

Snowstorm isn't their problem... as far as they are concerned.. you live walking distance from their office... its your problem to get it there on time. The rest isn't their concern. This is the real world.. not high school.

I don't come off to anyone as disrespectful and they know that very well, never had any complaints. I was actually told that the owner wants me to continue to stay in the property and my neighbors are highly pleased with me and my "attitude". I wanted a bit more info since its my first time living far away by myself. My credibility has never been questioned fyi I didn't say I wasn't gon pay I wanted a better understanding. Funny how its always the NooB's that try to tell those of US who have been here YEARS what the site is and what we can and can't tell them... did you even bother to read the site rules? YOU ask a question.. you get an answer... you don't get to dictate who answer or how. If you need reaffirmation of your incorrect beliefs talk to your friends... if you want someone to give you r the straight facts... then this is the place. WHO has to watch their tone? Did you even bother to read what you wrote? You come off acting like you can pay your rent when you feel like it and have every excuse in the book WHY its not your fault, then complain about them rightfully charging you late fees. Your entire post is about why you think they should cut you breaks every month you are not entitled to.

YOU are a tenant are responsible to pay the rent on or BEFORE it is due... there is no acceptable excuse to a landlord short of being in intensive care. YOU are acting like they OWE you, like you are doing them a huge favor by living there...
We were telling you like it is then you come off acting all high and mighty. And you DID very much come off as being VERY disrespectful to your landlord. Not in just one comment... but in nearly everything. Wasn't anyone here being "disrespectful"... and none of use including your landlord are your parents... and you aren't living at home any more.

These are the realities of life every one of us live with every day and you haven't learned yet.

I for one have managed to pay my rent and my mortgage on time for 29 years... and if you don't think that is extremely important... just look at what's in your credit history now for being late... yes late rent gets reported to the credit agencies... it will effect you with future jobs... it will effect how much your insurance is... it effects how much your interest rates will be on a credit card or bank loan and even IF they will even give you one.

You need to wake up and take this as seriously as it really is... and speaking as a one time landlord... tenants who are habitually late... aren't OWED respect... respect is earned by proving you are able to keep up with your responsibilities on time. And without drama. Nobody outside your family (and even they don't) want to deal with drama or excuses even once... and certainly not over, and over, and over... and an eviction WILL be an ugly mark making it hard to even find a new place to rent. As a landlord I would check up on prospective tenants... if they have an eviction in their past, guess what... rejected and on to the next applicant. I've rather have an extra month or two unoccupied to get a tenant that pays on time, than deal with someone's excuses every month that doesn't.

No I'm not going to kiss anyone's feet... I'm trying to get you to see the seriousness of the situation you are in right now... I guarantee you that your current and any future landlord aren't even going to be 10% as nice as I am being right now... or taking time out of their day to try to get you to understand. I've got other things to do... but I'm taking time to impress upon you the seriousness of the current situation since your parents haven't or aren't aware even exists to do it themselves.

What can they do? They can give you 30 day notice to vacate... if you don't vacate they go to court and have the Sheriffs show up, dump all your stuff on the sidewalk and change the locks... your neighbors then steal everything you can't get friends to haul to safety first in a hurry. If you want harsh... that's as harsh as it gets... you find a friend to sleep with or you sleep on the street because at that point you are homeless.

Yes... this IS that serious. And I'm hoping to get that through to you... before you learn it the hard way.

After reading through this thread, I still can't figure out how the fact that your rent has been late is caused by the weather.

As I understand what you are telling you, your parents in Texas have been sending money orders to either you or the management company in Colorado. It's possible that there could have been a snowstorm in Colorado in February, but how would that have delayed the receipt of the mail? You or the management company couldn't get to the post office to get the mail?

No SHE isn't close to being anything... dnt lend your assumptions cause you only know what I told you and this was to get an understanding so I do know and you getting close to the parents, watch your mouth snd again, your tone. And I must not be too "disrespectful" cause they are very fond of me from my southern charm to my pleasant demeanor. @AK Lawyer, the money order was sent days early to the company as they only accept cashiers checks and money orders. Feb was the month they had the most snow, the guy who's been handling things kept calling about the rent aftr I told him we been sent it and to check their mail again. The next evening he reassured me that he found it and they did in fact get it days ago; yet, I was still charged late fees even though they received it within my grace period. Also to my knowledge I think that guy was fired due to his incompetence with forgetting to get the other half of the lease signed and everything cause he was leaving me messages about the lease like it was my fault and I may be wrong but in my opinion that shouldve been taken care of before he put the key in my hand cause I was set and ready to go on my end. Basically, Im tryna get helpful info so I know how it works for future references. I'm enjoying being myself id rather have a little knowledge of whaf I'm going through to help me along the way. Don't get me wrong as individuals they are very cordial and polite and I give the same in return cause I imagine its not easy dealing with all these tenants plus more. Id rent through them again and the future.

So he didn't check the mail because there was too much snow between his office and the mailbox? That indeed would have been the management company's fault. Does your lease provide that there will be no late charge (as opposed to no breach of the lease) if payment is made within the grace period?

Yes my grace period is 3 days and that was his excuse after I kept telling him to check their mail thoroughly and he found it the next day, that same day he found it he continued to tell me his boss was upset woth him for not getting the 2nd part of the lease signed, but in my opinion that's his own fault instead of stressing about renters insurance I been purchased in order to obtain the property he shouldve made sure all paperwork was signed and and order before he gave me the key. Ever since those two problems occurred its been the same ever since like they taking advantage of the fact its coming from TX the excuse is "weather permitting" not mine, their excuse cause I pay anytime I owe it regardless I know that and they know I don't have a problem with it. I wantd to know right from wrong in details.

My knowledge of spelling and grammar is very eminent, again don't ""ume from what u c. I am typing from my phone and anyway its not interfering with your comprehension so don't worry about it. You have me undoubtedly mistaken lol.

On top of that, I shouldve done this before, I read reviews about the company saying basically all the same things such as poor accounting, bad people & communication skills, don't return phone calls, charge fees at their own convenience, poor upkeep and maintenance doesn't respond in a timely manner or never, etc. so now I know I'm not the only one that's been through this cause its 22 reviews and I have yet to see a good review but my fault for not doing my research, I needed a plave close to school quick so I chose this company

Use every excuse in the book... rather than accept its your responsibility to pay them on time.

I suspect you will find yourself evicted for breach of lease very soon, their current actions indicate they are preparing to do that.. And that will be on your credit history for any and all future landlords to see when you apply.

The issues here is, it is obvious that the renter knew the landlord was bad to deal with. In those cases, the money order would be mailed to the renter who would walk it into the office before the 1st and get a receipt each month.

The issue here, someone else is sending the order, and the process time of the landlord
If the lease says, received rent, not date of post mark, then the renter is liable to do what has to be done, to see it is delivered.

Don't they use the letter "t" in Texas? And - again - what school is this?

Based on my knowledge of the legal system (which, like your knowledge of spelling and grammar is very eminent) -

OK - this is what you want to hear. Your landlord is totally within his rights. Expect to get evicted.
