    Breach of Contract
    My husband and I recently moved to an apartment in Kentucky and in our lease it said that we would have a washer and dryer provided for us for free. We get to our apartment and there is not a washer and dryer. The manager said that we would forsure have it by Friday Feb. 23 by 5:00 and we still do not have it. They had said they ordered them from Lowe's. Well I call them yesterday and now they said that we were suppose to get another tenants, but they decided to extend their stay and we would have them by the middle of the week. Is this considered a breach of contract? What can we do about this?

    The fact that they lie doesn't make a breach but the lack of a washer and dryer does constitute a breach. However, the lease does not appear to stae a new washer, just a free washer. I would be calling the managers bluff on the lie and lack of washer. Ask for the name of the owner, his employer.

    Yes, it's a breach. But, they have a reasonable time to correct it. I don't know if the time they took is reasonable. Do you want to break the lease, and have a judge decide? If not, then there's nothing you can do about it.

    Of course, you can certainly negotiate a rent abatement. That would be like $150 off next months rent. If they don't agree, there's nothing you can do short of leaving.
