    Custody of children
    I have a major concern for my sister.. She finally left her boyfriend and father of her four children.. got a restraining order and he also now has child endangerment against him (he beat her regularly and was caught threatening to murder her and the children). Now he is threatening to take full custody of the kids. What are her rights? I am so proud that she finally got away from him, but now he is finding new ways to torment her and the kids.

    Does the restraining order include the kids ?

    Has she filed in family court for custody of the kids ? She has the right to present her case in court to show he should not get joint custody ( if he actually files, almost always it is threats to control the person)

    And/or present her case of his danger and ask for supervised visits only if he was to get any visits.

    So basically she has full right to present in court to prove why he should not get his rights.
