On may 14th I was called by my realator and told a tenant was ready to move into my house, how soon could I vacate. I said 1 week. I vacated on June 1st 2012. The new tenant has transferred phone and mail service and is receiving packages at the address as of June 6th. Today June 13th I was informed by my ex neighbor that an eviction notice was taped to the door?? I went there and viewed it to see I am to be in court June 21st and am being sued for 1 months rent?? Can this be done?

Which month are they asking for? June?

Did you have a lease. When was the lease due to expire?

Or, if you didn't have a lease, did you give your landlord written notice of intent to vacate?

Normally, unless you are behind in your rent, you should be given at least 30 days notice (or, here in Florida, 14 days). You apparently chose to forego that requirement and accommodated the landlord (or the landlord's agent realtor), and moved out with only two weeks notice.

You did move out about a week later than you said you would. Could it have something to do with that?

The lease end was July 31st. The realator called me asking if I could move before my lease end...

So is it necessary for me to file a legal response, or just appear in court next week with my pictures that i took of the house on my i-phone? I also have a fax of when i was asked to vacate early because they had an approved tenant. Should i request copies of the cleaning service and the mover?

You need to have the realitor as a witness in court to testify that he asked you to move. ** not that you just moved. Was the notice suing you from the same person who asked you to move ?

Did you discuss rent dues when you agreed to move?

It sure wouldn't hurt to file something. But you probably don't need to.

The pictures, and the copies of invoices from the cleaning service and mover: I'm not sure exactly how those would be relevant. It doesn't appear that the you are seeking a credit for those expenses; and I don't think you are entitled to them, so why would the judge need to see them?

You should definitedly bring copies of all pertinent e-mails, along with your lease.

Also, it would be good to bring copies of your rent checks, showing that you paid on time. Or get a printout (from the bank) of when these checks cleared your bank.
