    I'm married and my wife is having an affair and wants a divorce I had to quit work do to surgery so she started working.my mom and dad in Oregon says they will help me.I have a job ready for me there can I file for divorce in Oregon and not be charged with kidnapping

    If you leave with the children you may not be charges with kidnapping but you can be compelled to return the children to TN. You can't file for divorce in OR until you have lived their 6 months. So she can file for divorce in TN first and then TN will have jurisdiction.

    So you have not legally changed your drivers license to TN within the 90 days after moving there, which could cause your drivers license to be suspended ?

    And I have no idea what your mention of 5 years is all about ?

    If you leave the state with the child, your wife could file for divorce and child custody in TN and even ask the court to order to require the child to be returned to TN.

    Also just having an affair will not really even hurt her in court for child custody.

    You need a really good attorney in TN right now, not running away.
