    Prison?
    My boyfriend is required to register as a sex offender. When they checked his address his crazy drunk aunt said he didn't live there. They arrested him for failure to comply. Kept him in jail overnight, and the judge let him go. A week later they arrested him on a probation violation due to the first charge. This will be his third probation violation but not all for the same thing. His 'victim' was not a minor and to me this violation seems Minor. However they are threatening 2 years prison time... Any idea how likely they are to actually send him to prison? Any suggestions would help...

    Very likely - he's violated twice plus the "crazy aunt" violation?

    What was his violation? Registering as a sex offender does not come after a minor charge.

    Judy: his charge 3 years ago was assault with intent to commit sexual abuse... His violations prior were moving and not informing his prior county he left, and he got violated for being jobless too long amd not reporting it. This being his third... I'm scared. But its been over a two year stretch. Just looking for ideas on what might happen. Thanks

    Yes very likely he will go to prison now, he seems to have an authority issue and this is normally why the courts send them back. He did not report move, he did not report being jobless. His only chance is to prove he really lives there ( if he does)

    Mos people actually do their entire time on probation and never violate

    Fr chuck: he doesn't have an authority problem, he has a probation officer who never correctly informed him of what he had to do. He registered in the new county, but wasn't aware he had to report in person in the old county. Unfortunately misinformation has led to his demise, and agreed he should have done a better job communicating but It seems to me, he's not the only one who failed... Here's to hoping for the best, though its not sounding all THAT promising. Thanks for the answers.

    Sorry, this is not what the judge will see, remember the judge sees the reports and the violations. So the judge will view it the same as I do. Does not matter why or for what reason.

    I do feel sorry for you. To an extent I feel sorry for him.

    HOWEVER - "he's not the one who failed." Are you excusing him?

    Hello b:

    Without a good lawyer, they are VERY likely to get their way.. With one, the violation WON'T be sustained, because he did NOTHING to get arrested for in the first place...

    OR, they COULD be violating him for NOT contacting them when he was falsely arrested. THAT would be a violation...
