    Can he do that in California, Apple Valley He wants more rent money. I told him I would only be in the house for a total of 37 days. Was told the rent would be prorated.

    A 3 day notice can only be used if there is some violation of the lease. Otherwise he has to give you a 30 day notice. However, without a signed lease, you are a month to month tenant and your tenancy can be terminated at anytime with 30 days notice.

    However, you may qualify as a lodger under CA law (California Tenants - California Department of Consumer Affairs). If you do, you can be forced to vacate without a court hearing.
