My question is how serious is a class 1 misdeamor and how much time can u spend in jail for it. And what arrestible offense that can cause you to receive a class 1 misdeamor in Georgia?

Unknown how it was violated spoke to the probation officer which gave no answer stated he could not talk over the phone. I haven't got in trouble in 4 years and I served my time and paid all court cost. I found out I had a warrant in Georgia for Vop when I applied for my green card a few months ago. I only got arrested once since I served my time in Georgia, which occurred in Florida for domestic with my wife( it wasn't an assault)which was dropped and it happened in 2008 the last time I was arrested

I know you're trying to help your friend, but he hasn't given you enough information with which to seek help... Your question is like asking what is the severity of a ticket...

It matters what the ticket is FOR, just as it matters what the misdemeanor is FOR... The probation officer will TELL him if he asks. Plus, it wouldn't be the PO who informs him of the misdemeanor. It would be the COURTS. If he hasn't been to court, then he can't have been convicted of a misdemeanor..

So, if you get more information to give us, I can help you better.

I apologize I was trying to explain the situation in his words but thanks! I will contact him for more info! He's in a tough situation he really change his life and will go and turn himself in but wanted to get an idea how much time he will spend in jail he hasn't gotten himself in trouble in 4 years do you think they would take that into consideration and he'll have a written letter from a ct state representative and church vouching for him that he is a change man and not the same person 4 years ago

You want to talk about the punishment, but I don't know WHAT he did. From what you say, I'm not sure he did ANYTHING. Certainly, if the COPS aren't prosecuting him for this alleged misdemeanor, there ISN'T one. And certainly, if the cops DID prosecute him for it while he was on probation, he'd remember it, wouldn't he?

So, before I can begin to tell you what MIGHT happen to him, I need to know HOW he violated the law.

I just spoke to him and he informed me they could not give info over the phone because he called them and they could not confirm it is him. But they said it was a violation of a class I misdemeanor and it was a warrant from there office not from the PD.

I am in GA, was a state officer in GA, your terms are confusing, but here is what it sounds like to me.

His first crime he is on probation for was the "class 1 misdemeanor. He violated it, and the violation caused a warrant to be issued for violation of probation.

The warrant would be the same status as the crime status that they are on probation for.

The violation does not have to be a "crime" it could be failure to report, some fine they forgot to pay. Being around someone who is on probation or parole, Being out to bars or a dozen other things, that are legal, but would violate the probation.

And I am sorry, I can't believe that he does not know what he did, most likely something he did not think was anything but it got him violated,

Has he missed any meetings, had any dirty UA tests ? Not pay some fine due ? Get speeding tickets or some other tickets that he did not report ?
Have other contact with police he did not report ?

How long would you think it would take for my friend to see the judge? I spoke to an attorney and he said because it's a warrant issued by the probation office my friend could be sitting in jail for 30+ day before he sees a judge for his probation hearing

Is it better for him to turn himself in to a police officer because he would be arraigned within 24 hr and get his disposition. Rather than turn himself in @ probation office?

It won't make any difference. There's no bond on a probation violation no matter who you turn yourself into. 30 days sounds about right.

Can a lawyer expedite the hearing if possible?

And also can his lawyer get his disposition for him?

An attorney may, but often the system lets him stay for a reason, at the hearing it is common to get the timed served and put back on probation.

The other reason, they often only hear probation cases one day or two days a week, and sometimes less in some areas, so the calendar could be full.

And attorney never hurts, but often they have no control, since this does not fall under any speedy trial issue.

But seldom is it less than 30 days, and seldom is it over 60 days.
