    violated my probation over 10 years ago
    I violated my probation over 10 years ago in Fl. I recently got charged with an erroneous charge but brought up my old stuff of which I honestly forgot about. I hired an attorney in fl and now I'm so scared. I have a 4 year old and I'm terrified to loose her to my ex husband if I go to jail. How much jail time should I expect. Please help

    What was the original sentence? How much of that was jail time and how much was probation? How did you violate your probation and how much probation did you have left at that time?

    Sentence was not to exceed 12 months probation/jail time.

    I was put on mail in probation had 8 months left. Failed to report and fulfill 100 hours community service, 3 drug test and fines.

    Just so I understand - your argument against jail is that you forgot to report, forgot to do 100 hours of community service, forgot 3 drug tests and didn't pay your fines?

    OR did you do some of these but not all?

    Ok, so 10 years ago, you violated the probation that had up to 12 months jail time.

    So 10 years ago, they issued a warrant for your arrest in Fl and for some reason you have not been found.

    So are you now sitting in jail, If not, I will assume that means you no longer live in or near Florida ? Just guessing, no one here can give you really good answers when we are guessing at details that are real important.

    It is very likely your attorney can arrange with FL for you to turn yourself in, -do a min of days in jail waiting for a hearing and get back on probation. To finish the probation time there.

    How this can or will effect your custody of your child, will be up to the family court where you are at.
