I purchased a home in NJ last year and needed to add my brother to the mortgage and deed as a co-signer because I did not qualify for the mortgage on my own. The deed is worded with the Grantees as: (sister's name), an unmarried person, and (brother's name), and unmarried person. I am unable to refinance the house right now to get my brother's name off the mortgage and deed. My question is, what happens to my brother's 1/2 of the ownership if he dies? Does it go to me or to his children?

If the deed does not list right of survivorship, then it goes to his heirs.
