By the way, I see from your name that the family dynamics are not good; has your father made a will yet? If he has made a will naming her as beneficiary, there is not much you can do about it, common law or not. Fortunes have been left to pets !
A person can leave their money, property to whoever they want.
Do you not have a good relationship with your father ?
ANY question on law needs to include your general locale as laws vary by area. And this is a legal issue not one of Personal Growth (where this was originally posted).
Common law marriage has been mostly done away with. So if she can't produce a marriage license, she may not be able to make a claim on the estate absent a will.
So you should encourage your father to make a will and leave it with a local attorney.
