    I was terminated from my position with a large corporation while out on disabilty.
    I don't qualify for FMLA but another employee in my same position was allowed to return to his job after 3 1/2 months, I could have returned in 5 weeks.
    Do I have a course of action />??

    Likely not... they aren't required to hold your position open forever... and what happened with one person isn't the same as yours is.

    WIthout a contract you are at-will, if you are at-will, you are their at their will... as well as your own... if both sides don't want you to be there... then you won't be there.

    You can hire a lawyer... spend a year or more fighting, and still lose. And even then... if you managed to win that... you would be under the microscope and they would find a reason to get rid of you or make you want to quit.
