    Can I move out of CA with my 2 yr old if me and his father have joint custody?
    I am in the middle of a divorce and want to move to Colorado where my boyfriend is stationed (he is in the Army) we are getting married next year. Does being married again change anything?

    Nope, as long as the bio father agrees to the move you can move, ** assuming the child custody agreement states that. But if he has joint custody, how can he do that from another state.

    Well of course you can move anytime you want, you just can't take the kids, he would keep the kids and you would arrange for visits. But for joint custody, ( physcial) you have to live near enough to each other to make it work. Some joint custody does not work if you live more than 10 or 20 miles apart.

    As long as the divorce is in process you can't do anything without court permission. What you need to do is negotiate with him over custody and especially visitation. If you want primary custody you will probably have to offer him summers and school holidays.

    Also be prepared to pay for all the flights for visitation if you're the one doing the moving. There should be no added expense to the other parent .
