Your mom has to give him a written notice that his tenancy is terminated and he must move out within x number of days. The number depends on your location but in most places it is 30 days. Tell us which state you're in and we can tell you the exact number.

If he doesn't move out within that time then your mom has to file a lawsuit for eviction.

Yes, you evict him just like any one else. Also why do you let him use the car, just refuse.

How does he have a key?

Was there an original agreement to pay rent? If so, you either give him a 3 day notice to pay what he owes or a 15 day notice prior to when rent is due to vacate. If he doesn't vacate then she goes to court for an eviction order.

As for the car, lock up the keys make sure he doesn't have access to them.

In Pennsylvania the notice period is 15 days if the tenant has lived there less than one year but 30 days if they have been there for more than one year.

So have your mom hand him a written notice that his tenancy is terminated and he must move out within 30 days.

She probably gave it to him at the get-go.

Take it while he is sleeping?
