Your boyfriend OWES that bank $11,000 Dollars... (he spent that money after all or the bank could have simlpy taken it back resulting only in the returned check fees.) SO that money legally wasn't his to spend.

Depends on whether the judge or jury believes her story (presumably that she is an incompetent bookkeeper and didn't know that there was no money in the account). Does she know that she is supposed to keep track of the amount of money in the account?
