    Need help to file my taxes on OPT to H1
    Hello,

    I came to US on jan 2004 as F1.dec 2005 to dec 2006 OPT . Dec1st 2006 H1

    1. CPT started:
    Aug 2005 to Nov 2005
    Worked on CPT in internship from Aug 2005 to Jan 2006
    Here my OPT started on Dec 10th 2005
    (I continued this job in my OPT for 2 months dec05 & Jan 06)

    This is my 1st W2 for the month of Jan06 . Company A

    (SSN & Medicare was not deducted)

    2. OPT period started:

    Dec 2005 to Dec 2006
    Worked on OPT from April 2006 to Dec 2006.
    Got H1 approval effective from Dec 1st '06.

    This is my 2nd W2 form April to Dec 2006.Company B

    (SSN & Medicare was not deducted on my OPT payroll till Dec 2006.
    But here my H1 started on Dec 1st 06)

    I am married but single as student in US.MY husband & kid is in India with valid H4 visa. They are coming to US in May 07.

    3. In My OPT period I also worked on another project on 1099.Company C



    Now my concerns are

    1. Now how do I claim my full tax returns with 3 different W2?
    2. Which Tax forms do I need to fill?
    3. How can I mention about 1099 income?
    4. Can I claim taxes for my dependents for 2006 though they are in India?
    5. How do I apply for ITIN (W7 form )

    It would be grateful if you could give me your advice in this regard.

    1-4) You need to file Form 1040NR with a Schedule C, claiming the income from all three W-2s and the 1099 income on the Schedule C. You can also claim your husband and child as dependents under Article 21(2) of the India-U.S. Income Tax Treaty.

    5) Fill in the W-7. Get your husband's and child's passport photocopied, and have the photocopy notarized (the U.S. consulate in India will do this). Email the PDF W-7 to your husband so he can sign it. He mails you the notarized passport copies with his signed W-7. You sign your child's W-7. Attach these documents to the 1040NR with the Schedule C.

    I really appriciate for your quick response...

    1.US consulate in india is very far for us. Can we take notary in any local court or any established banks. is it acceptable?
    2. with all these docs & 1040NR do I need to go to local IRS or Certified Acceptance Agent before submitting.

    1) A local notary should be find, just so long as the IRS can contact him to verify the signature.

    2) No, that is NOT necessary.
