J1 / Q1 wrong tax form filed? What is the correct one?
    Hi,

I have a question regarding my tax filing.

I came to the US in 2004 on a Q1 visa and filed my taxes on 1040-EZ. The next year in 2005 I was on a J1-visa and also filed my taxes on 1040-EZ. Now, for 2006 I am still on a J1-visa and wanted to file again for 1040-EZ, however this is the first time I realized that there is a specific tax form 1040-NR to be filed for J1 trainees. Now my questions:

    1. Can I still file for 1040-EZ for 2006 even though I was on a J-1 Visa?
    2. If I have to file 1040-NR for 2006, do I have to change my filing for the previous years?
    3. Can you recommend any good CPA accountant who is experienced with this visa types/tax filing for non-residents?
    4. There is one more problem... in 2005 I only filed for taxes from my J-1 income, however I did not receive the W2 form from my 2nd employer who I worked on a Q-1 at? THat means I only filed the taxes for 1 employer, instead of also the 2nd employer. Do I still have to file something for 2005?

    I appreciate your help,

    Rommy:

    1) I need more specifics about your J-1 visa. I suspect that you should file Form 1040NR-EZ.

    2) You filed incorrecy for 2004 and 2005. You will need to amend those returns to set the record straight.

    3) Yes, me! If you need professional tax help, contact me at [email protected].

    4) Another reason to amend your 2005 return. The IRS will figure it out eventually and come looking for you, as there is a paper trail for the W-2 you did not include in the tax return.
