I was in a car accident in October of 2008 in ILL. The attorney for State Farm filed the sue in 2008. I didn't know about this until this year. Now they are doing a citation to discover assets issued. The thing is that I am not a legal citizen. I have not appered in court or have not been served properly. What should I do? I thought this lawsuite will go away in 5 years, is that true? The amount they are seeking is way beyond what I could pay, and way more of the damages cause to the car. Can I just do a agreement with the attorney office and not go to court? What do you recommend?

Did you have insurance at the time of the wreck, is so, they should be the one handling the law suit for you, but often they may sue for more than your insurance amount, for example too many people only carry about 50,000 in personal injury, a 3 week hospital stay can be in the 100,000's

But you can try to settle with the attorney but they may or may not. If this is the discovery part of it, there is no court date set and they just want to know about what you have. You really need an attorney to handle this for you at this point.

Civil court will not ask and don't really care about your immigration status. You have a right to see a complete list of all moneys they are asking for. Proof of damages

Give you an example of costs, I had a wreck a few months back, both cars were driven away, I was sued for about 80,000 dollars

Contact the clerk of court and ask. Or, better yet, go to the clerk's office and ask to see the file.

No. If the "5 year thing" is the statute of limitations, they satisfied that if they filed the suit within 5 years of the accident.

That's why they are engaging in discovery.
