I signed a 1 year lease in October with 2 roommates. I was 9 months pregnant at the time. My son is now 6 months old and my roommates are very loud and disrepectful.My sons father was unemployeed at the time and we couldn't afford a place of our own. So we live separetly now but he's getting a job soon and we want to get a place together. The roommates are fine with me leaveing and are willing to pay the whole rent, they even have someone ready to move in when I leave. I read the lease and it just says that if we terminate the lease early the sercurity deposit is void. But it doesn't say anything about if just one person leaves. My question is How do I take my name off the lease so I can move? Or do I just have to wait it out? Also since the landlord didn't do a credit check when we moved in will moving out effect my credit?

If your name is on the lease, then you need to get WRITTEN approval from the landlord to release you from the lease.

If your roommates are agreeable, and have a replacement, you should get the roommates to release you from your obligation and ask the landlord to sign it as well.

If they have a replacement have the replacement give you their share of the deposit.

That might work... but the bottom line is that the landlord must agree.

Thank you everyone for your help. Now do I tell the landlord I'm looking or do I get ducks in a row, so to speak, and then tell him all the info at once a month or so in advance?

You tell him when you give 30 days notice. But, in the meantime, prepare the document for signature.

Muffin, you cannot give a 30-day notice in this case. What you need to do is speak with the landlord to confirm that he will release you from the lease. But yes, having something in writing from your roommates confirming that they promise to pay the rent on their own will help.
