My daughter, who is 8 months old, is in fosters care from last 2 months because of her injury (femur fracture). I left my husbands house a while ago because of violence. The case is in the court and Police investigation is on as well as the local authority thinks this as a case of child abuse when this is untrue. I am living on my own. Can I get my daughter back?

Not enough info. How did she break her leg? Did it happen under your care? Did her father do it?

If children's services has put her in foster care, you will have to do exactly what they dictate to prove you are fit to get her back.

Thanks for your reply. Her injury is a big shock to all of us. I was the main carer but other family members, my husband and his mother used to luk after her as well while I used to do kitchen chores in the evenings. I am ready to do whatever it takes to get my daughter back, as its only me and my daughter who's been suffering.

Have you talked to the caseworker? You seem to not even know exactly how it happened. An 8 month old should be under near constant supervision, so someone should know how it happened.

CPS will tell you what you need to do to get your daughter "back" - as well as IF you can get your daughter back.

Thanks all for your advices. I remember one incident when my husband was playing with my daughter. He was holding her while she was getting happy and hyper on the bed, suddenly she slipped off his hands and almost fell off the bed backwards, immediately within a fraction of seconds, my husband pulled her back on the bed, he held her right leg from his right hand and her left side of waist from his left hand. I immediately ran towards my baby and held her, comforted her and put her to sleep. Now, I think this incident might have caused the injury as my husband used his full pulling pressure to pervent my daughter from falling. As my daughter was only 5 and half months then, she was so much delicate to handle.

At the same time, I don't know why my baby didn't have that unusual cry for a few days after the incident, though she was quite and slow, and her appetite was low as well.

The recent change is I got separated from my husband and family because of violence.

Please advice, if this incident proves the cause of my baby's injury, will I be able to get my daughter back.

You don't seem to know if it's child abuse or not. How was the fracture discovered? Evidently someone became aware if it some time after the injury. So apparently you do not know.

I am not a medical expert. But the need for an expert to evaluate the sutuatin is why they are investigating. It's apparently a complicated question for the professionals to answer. Both you and your husband are suspect, I imagine.

Again, have you spoken to the case worker? They should be providing you with a blueprint of what is necessary to get your child back. You need to work it out with them. As long as you meet their requirements you should be able to get the child back.

Thanks scott for your advice. Yes I have been complying with all the rules social services have set for me to follow during this period.
This long period without my baby is so hard and painful for me but still I'm very hopeful and positive about the future.

Thanks AK for your advice. Yes, me, my husband and my parents in law, we all are suspects, but I have been honest and truthful for whatever has happened till now. My husband and family have gone against me blaming me for everything and forcing me to hide all past domestic violence issues.

So you are lying to CPS about past domestic violence?

No I have never lied about my past, and that's the reason I left my husband and family recently, as they were putting too much pressure on me to hide the truth.

That's good to hear.

Something's just not adding up. I'm not saying you are lying at all, please don't think I am. But the femur is the strongest bone in the human body, it is the thigh bone. Very hard to break even on an infant.

How did you find out it was broken? Did you take the baby to the ER?

I found out about my baby's injury while changing her nappy in the morning, when I saw her right upper thigh badly swollen and the same day she got admitted in the hospital. I stayed with her in the hospital for about a month caring for her.

Hi all, I have given additional information to the police telling them about my husbands incident with my daughter while she was playing aand slipped off his hands. But the police seemed to be not believing the truth as they say why I'm coming up with this story after such a long time, but the truth is I reported this incident to everybody the moment I remembered it and I remembered this incident only after luking at the Radiographer's report which clearly stated that this injury can happen by a swung or pulling pressure on the baby, and so I think this incident might have caused the injury. I am telling the truth to everybody, I can only tell the truth, how do I prove it?
