My boyfriend lives with me. He does not pay any bills, he does not get any mail and his name is not on anything regarding my house. We started living together and he was in and out trying to work on our relationship. He decided 5 weeks ago now that he was leaving at which time he said he would be leaving in 30 days. The tension in the house is great and we have had to call the police twice. My question is what type of eviction procedure do I go through since there is no lease or rental agreement? He veribally told me that he was leaving and now he is just sucking the life out of my home. Is that verbal notice as binding as us verbally saying he could move in?

Therefore, notice is moot. You don't give a trespasser notice. You put him out and change the locks. You can call the cops, who will standby while you do it, if necessary.
