I born 75 years ago. Since the new law requires a person to have birth cetificate I can't get a ID card or diver license. I have tried the sate of Idaho and there is no record of birth. I have tried the U S Census of 1940, they didn't find my family at the address I through was the adders.s I lived at. I have to idea what address I was born since both parents are died. I have school records, military records, I do have my parents marriage certificate on the back my mother recorded everything about my birth. Still the state sahs I need a court order.

First its not a good idea to piggyback your question on another thread. To avoid confusion your post has been moved to its own thread.

Did someone tell you what law is requiring a birth certificate? If you you are being told you need a court order to get one, then file a petition in your local Family Court to have one created for you. You seem to have enough documentation.

The DMV says you need a court order before they will issue you an ID card or diver license? You have never had a diriver's license before?

If that's what they say you need, apply to the court for an order estabishing the facts of your birth. Present the judge with the proof you have, and that should work.

Did your mother write down where you were born, such as the name of a hospital, or any clue as to where you were born, what state, if not Idaho? Name of a town even?

The state of Idaho told me I need a court order to get a delayed birth certificate. I have a di\ivers license but it has expired. Can I apply to the family court with the information I have. I do have my mothers marriage license. On the back she wrote the date I was born the time, and the hospital, which was 1937/06/02. The sate said they couldn't accept it.

My mother on the b ack of her marriage certificate, my name, the date I was born , the hour and time the and the doctor, the hospital no longer in business. I don't know where to find the hospital records

If you were born in a hospital, it is strange that the hospital apparently failed to submit a report of your birth to the vital statistic office. Is it possible that records were distroyed at some point (the public record repository burning down, for example)? Is the hospital still in existence?

Also, as I understand what you said earlier, you were in the military. How old were you then? They should have a copy of your birth certificate even if the original records got misplaced somehow.

Two of us told you would appear to have enough documentation. So file.

There is no records anout my birth at Idaho vital records. I was in the service but all records between 1950 to 1973 were lost in a fire. I was in the service 1957 so there is no service records
I tried schools, churches, U S censes of 1940, I have a marriage certificate for my mother and father on the back she recorded my name, date of birth, time of birth, and hospital.

You're telling me that our Department of Defense lost all records from between 1950 and 1973? I don't believe that. Not for an instant.

Redundancy is worth while.

I have to agree with AK, I can't imagine that the DoD lost all records in a fire. By 1973, those records would have been in the Pentagon or a secure facility as well as being duplicated.

So you are telling us you don't get VA benefits?

Look, its really very simple. You claim you were told to obtain a court order for a replacement, from what you have told us you do have enough documentation to get it. So stopping telling us fairy stories and go to court.
