    Mom forcing a sale
    My children live with me and the mother stop seeing them and in the past 2 years had not helped at all, now out of nowhere she wants a divorce and wants us to sell. One of the children are minors. Will the law in Florida force us out?

    First its not a good idea to piggyback your question on another thread. Especialoly a sticky that has nothing to do with your question. This can lead to confusion. So I've moved your question to its own thread.

    So sell what your house? If she owns part of the house she may be able to force a sale or you to buy her out.

    To advise you we need more details.

    Is her name on the deed or just the mortgage or both? I'd suspect the sale would not happen before the divorce anyway, not in this market. Home prices are still dropping.

    I would assume you have never filed for divorce yet ? How about child custody ? How about child support ?

    But often one parent may get the home in the divorce but may have to pay for the share of the other person. This is all part of what you fight out in divorce court.

    Could they force a sale ? Maybe, you need an attorney and deal with the divorce and other child issues if they are not dealt with yet.
