    Old credit card debt in NC
    My wife was recently contacted by a debt collector regarding an old credit card debt. After talking with the representative, I determined that the last activity on the account was a payment in 2008. When I brought to her attention that this was beyond the 3 year statute of limitations on a revolving debt, she claimed that the action was being filed as a promissory note. Can an open-ended, revolving department store credit account be converted to a promissory note? To my knowledge, she never signed anything agreeing to pay any set amount. Thanks in advance for your help.

    Collection people lie, they will threaten to have police come arrest you, threaten to have someone take your car in the middle of the night, and threaten to find a way to sue.

    You risk saying something stupid talking to them on the phone, don't, notify them not to contact you by phone again, don't talk to them, require anything in writing, if you do talk to them on the phone notify them you are recording them ( and do so) I bet their story changes if they don't just hang up

    The phone call was merely to get information. They claimed to have mailed stuff to her ex's house (which we have no knowledge of but can't dispute). I've dealt with these kind of folks before and know better. I told them to send me info regarding the debt. Once I verified the last transaction date, I knew they were beyond the SOL.
