    Court Date
    My boyfriend had a scheduled court date and he is currently incarcerated. He has been incarcerated since October 23,2011 and his court date was set April 23,2012. The day he was supposed to go to court he says he didn't go. Can somebody please tell me why and how is this possible?

    Well it could easily have been rescheduled.
    This is a question that your boyfriend needs to find out about.
    Either way whatever he has done is deemed serious enough that he is being held on remand pending the court case.

    So basically there is nothing I can do? They can just reschedule his court date and not even tell him about it?

    Is he incarcerated for the same crime the hearing is about? If so, it is the prosecutor's job to make sure he is in court. If it's a different crime, then its his attorney's job to make sure the prosecutor is aware of where he is.

    He can't be held responsible for not appearing in court if the prosecutor didn't send for him to be there.

    Yes Mr.Scott it's the same crime and that's what I don't understand. How can they not take him to his hearing knowing when it is and where its held. This is killing me and I don't know who his public defender is either.

    So how do you know about any of this? Did this info come from your boyfriend? Could be he is not telling you the whole story.

    But I find it highly unlikely that the prosecutor would not arrange for him to appear.

    There are times ( for example last week the Atlanta jails ( city and country) their computer systems were completely down for 1 to 2 days, any inmate transfer, inmate release were all held and not done till the systems came back up.

    Often the DA may ask for a new date because evidence is not in, or other cases have taken longer. His own attorney may have had to reschedule for some issue,
