    My daughter who was 24 y/o at the time used her younger brother's Social Security # and instead of Gabriel, she used Gabriella to obtain cable in her home. My son Gabriel who is 18 now just found out through the Credit Bureau that he owes $237.00 for this bill which has now went into collections. As the mother of both, my son now wants to file child theft charges against his sister for identity theft. My daughter used his SSN when he was only 10 years old. What will happen to her? Please let me know.

    If this happened 8 years ago, its possible the Statute of Limitations has expired and they can't prosecute her. Its also possible the SOL has expired on his ability to sue her for the amount.

    Given the circumstances, if she is prosecuted, she would not receive jail time, but would have a criminal record.
