Hi there,

I recently moved out of an apartment that I shared with a roommate and he remained. Our lease is currently month to month and I gave my 30 day notice which my landlord received however he will not take me off the lease since we both co-signed it together.

I live in Los Angeles, CA. Is this legal to not let me out of my lease since my roommate decided to stay since we co-signed? I don't expect anything to bad to happen but in the worst case scenario I would be liable for any damages incurred if my roommate defaults.

How long did you live there with the month to month agreement? How did you go about notifying the LL that you were leaving?

Beginning in January of this year it become a month to month lease.

And the notice

Oh apologies, I sent a fax to the property manager's office more than 30 days before I moved out.

Do you have confirmation of receipt of that fax? If you do you should have no worries.

The link only refers to landlords terminating a tenancy. I think it meant for landlords why are trying to involuntarily remove a tenant.

I am referring to the states definition of legal service. I doubt they would have a different definition when the roles are reversed
