Arrested for shoplifting... Still haven't received citation
My step-sisters and I were caught shoplifting. The cops pulled us aside it kohls, and claimed to be arresting us. They took down our info and banned us from any kohls in Arizona, but said that they had to let the court decide if they were going to charge us with either a felony or misdemeanor, because of the value amount stolen. They clearly stated that we were being charged with theft. Its been over a year, and we have not heard anything back. Did they drop the case? How do we find out?

Assuming this was really cops ( where they in uniforms) not just store security guards, they were just scaring you, it was just BS. Esp after a year. It is common esp if you are younger kids. The cops would know if it was a felony or not, plus depending on where you live, they would have taken you to the station then or given you a date to report for fingerprinting.

If you were clearly being charged with theft you would have left in handcuffs.

This is a case of letting sleeping dogs lie.

First question is whether you are sure they were actually police officers and not store/mall cops.

But, if you haven't heard by now, you haven't been charged. I would let the matter drop. If you go to the police to ask you may stir things up.

They were uniformed cops. In Arizona, any theft over $1,000 is considered a felony. The theft total price was $997, so they said that they were going to have the courts decide between a misdemeanor or felony. They let us go, because we had our id's for proper identification.

Court taking almost year and a half to decide charge for shoplifting
Caught for shoplifting in Arizona, amount was $997. It is felony for anything $1,000 or morr. Cops said they would have to let the court decide to charge as a felony or misdemeanor. Is been over a year and 4 months. How long are they able to keep a shoplifting case open and still chargd you?

I'm not sure if the phrase "charged" means "arrested" or not. Is the question have they actually been charged, when do they appear or something else?

They said that we were technically being arrested. They did not take us away, just pulled us aside and took down our info and said that we would receive our citations when the courts decided if they were going to charge us with a felony or misdemeanor.

If you were not given a ticket, if they did not take you to the police station, you were not "arrested" you were detained. They would have charged you, and then if the DA or if the grand jury wanted to change charges, they would.

What you said, just really is not the way it ever works.

    Hello m:

Justice is slow, but not that slow. IF they were going to CHARGE you, they would have LONG ago. Go on, and live your life.

Okay, I have the same problem. I'm from Texas, and I was finger printed, picture taken and everything when I was arrested for shoplifting. My mother hasn't really done any of my paper work stuff and I moved addresses. Now I live with my grandma. I was arrested in 2010 (sophomore in HS) and it is now 2012 (about to graduate next month). I don't know if I'm supposed to go to court? When.. Can I apply for a job?
