First ANY question on law needs to include your general locale as laws vary by area. Though by using the term council tax, I suspect you are in the UK.
As for moving back, that's not as much a legal issue, but a marital relations one. If you can reconcile with him, you can move back.
I don't believe the UK uses the concept of community property, but my research indicates that the UK divorces are very much geared towards the wife. However, since YOU left, the courts may look at it differently.
What rights you have to the house could depend on whether it was purchased after the marriage or not.
I would strongly suggest you consult a solicitor before you do anything else.
