31 days continious stay during 2011 for first year choice as resident alien ?
I travelled to US from UK via Munich on 1st December 2011 arrived at 4:00 pm afternoon. I would like to wait till I meet the SPT in 2012 and then file as resident alien for tax year 2011.
However I should be present for a continious period of 31 days during 2011.
Under days of presence in US -. Page 5 of pub 519 states, "do not count the day you are less than 24 hours in US and in transit". - Does this mean I cannot count 1st december- the date of travel to US ?
If so, I would be present only for 30 continious days in 2011 and would not be able to file as resident alient even after meeting SPT in 2012 ?
Please advise if there is any way for me to be classed as resident alien for 2011 tax year after meeting SPT in 2012.
