    Court date in less than 2 weeks- case not assigned?
    My court date for theft under 5000 and personation is set for a little less than 2 weeks from now. This whole ordeal occurred on February 8th, so the court date was assigned approximately 2 months after the fact. My lawyer has been calling the Crown attorney's office, and they keep telling him that the file has not yet been assigned. This concerns me because there will be no chance for discussion of a pre-trial diversion program, disclosure to my lawyer before the court date (and thus no time to prepare the case) etc. I am also extremely concerned that when I go to my court date, the file will still not have reached the Crown attorney and the hearing will be adjourned and set to a later date. This whole thing is literally haunting me- I cannot sleep, I wake up with night terrors about being arrested when I do, I can't focus in school and my GPA is decreasing. I have started going to therapy because I am so depressed and doubting the type of person I am. I just want to deal with this. I have heard that if the file hasn't been assigned by the court date, the charges will be stayed. Does anyone have any input on this? Thanks.

    Often your attorney and the Crown will discuss this in the court room prior to court, ( I have not seen it happen in Canada, but in GA the majority of minor deals are made at the day of court.
