    How can I get her out of my house?
    I have rented a room to a young woman. There is no written rental agreement. She has been there about 3 weeks. She is on a week to week basis. She has stolen items in my house, and broken a cabinet. I have filed a 30-day eviction with the court. If she does not pay rent on time, can I ALSO file a 5-day eviction for non-payment? Does one eviction notice cancel or take precedence over the other? I want her out ASAP. I no longer feel safe with her in my home.

    The laws differ by State. What state are you in?

    Regardless, you cannot file an eviction notice if the resident delivers rent to you.

    But on the plus side, some states are lenient on the notice to move if they are renting from you in a dwelling where you live, or in a "rooming house".

    So to be able to help you, please clarify these things:
    1. What state are you in?
    2. Is the person renting from a dwelling where you live?
    And if the answer to #2 is "No", is the person renting in a dwelling where multiple residents are renting from you? (Like a "rooming house").

    Probaby. When you file in court for eviction, you would describe what notice you gave her. The first notice will probably not be considered any kind of consent to remain 30 days, in my opinion.
